Responsibility And Independence Of Commissioner

(1) The Commissioner is responsible to the Minister for—

(a) carrying out the functions and duties of Police; and
(b) the general conduct of Police; and
(c) the efficient, effective, and economical management of Police; and
(d) tendering advice to the Minister and other Ministers of the Crown; and
(e) giving effect to any lawful directions by the Minister; and
(f) ensuring that Human Rights are upheld under all circumstances.

(2) The Commissioner is not responsible to the Minister, but must act independently, regarding—

(a) maintenance of order or enforcement of the law in relation to any individual or group of individuals; and
(b) investigation and prosecution of offences; and
(c) decisions about individual Police employees.
